This policy (“Privacy Policy”) sets out the terms on which Vaticle Ltd (also variously referred to as “Vaticle”, “we”, “us”, or “our”) collects, uses, discloses, and protects user data and personal information at our website located at typedb.com and any other Vaticle platforms or services that link to this Privacy Policy.

Vaticle offers various products and associated services (“Vaticle Products” which in this Privacy Policy include (as applicable) Vaticle software, products, services, websites, apps, servers, and devices.

This Privacy Policy applies to the interactions Vaticle has with you as its customer and to the Vaticle Products; if you do not agree with the terms of this Privacy Policy, do not continue with this website, or use Vaticle Products.

WHY WE PROCESS PERSONAL INFORMATION AND ON WHAT LEGAL GROUNDS

Vaticle collects and stores data from its customers, through our interactions with you and through our Vaticle Products. Customers provide some of this data directly, and Vaticle gets some of it by collecting data about its customers interactions, use, and experiences with our Vaticle Products. Our legal basis for processing your personal information will depend on the personal information concerned and the specific context in which we collect it.

We will normally process personal information from you only: (i) where we have your consent to do so; (ii) where we need the personal information to perform a contract with you; or (iii) where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. We have set out our specific legal grounds for processing your data below.

In certain circumstances, we have a legal obligation to process personal information about you, or need to process personal information to protect your vital interests or those of another person. If we ask you to provide personal information to comply with a legal requirement, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the consequences if you do not provide your personal information).

WHAT WE COLLECT AND HOW WE USE IT

Information: Vaticle collects and stores information and data from its customers, through our interactions with you and through our provision of Vaticle Products.

Communications: We use information to communicate directly with you. We may send you emails containing newsletters, promotions, and special offers. We also use your information to send you Vaticle Product-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of Vaticle Products, and technical and security notices). You may not opt out of Vaticle Product-related e-mails unless you decide to terminate your Vaticle Product account.

Cookies log file, and web beacon Information: Cookies are small files saved to the hard drive of the user’s computers that track, save and store information about the user’s interactions and usage of the website, including preferences and settings. This allows the website, through its server, to provide the users with a tailored experience within this website. A persistent cookie remains on your hard drive after you close your browser. “Web beacons” (also known as “clear gifs”) help deliver cookies and gather usage and performance data. Log file information is automatically reported by your browser each time you access a web page (such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links, domain names, landing pages, pages viewed, and other such information).

We use or may use cookies, log file, and web beacon information to monitor visitors to better understand how they use this website, to improve our Vaticle Product(s), and to ensure the security of our website. Cookies will not store, save, or collect personal information.

Where applicable this website uses a cookie control system allowing the user on their first visit to the website to allow or disallow the use of cookies on their computer / device. Analytics Information: We may use third-party analytics tools to help us measure traffic and usage trends for Vaticle Products. These tools collect information sent by your browser as part of a web page request. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Customers’ Use of Vaticle Products for third party end-users: Vaticle only processes and stores data as authorized by its own customers through their use of Vaticle Products. Vaticle does not have a relationship with its customers’ end users but rather only with its customers, the data controller. While Vaticle recognizes that a customer’s end user may have rights to access the data collected and stored about that individual, if you are an end user of one of our customers and you would like to amend, delete, or alter your data, then you need to contact that customer directly.

Personal data: Personal data is information that relates to an identified or identifiable individual (“Personal Data”). Vaticle customers have choices when it comes to the technology you use and the data you share. We collect Personal Data when you provide such information directly to us such as your name and e-mail address when you register for an account, or if you correspond with us (in which case we may also retain our responses) and additional information, such as your credit card number and billing address, if you purchase Vaticle Products.

Account Credentials: Details that you provide in order to have an account with us for the purposes of receiving our Vaticle Products. These details include your name, email address and password. To maintain your account with us and to deliver our Vaticle Products. To perform our contract with you and to deliver a Vaticle Product, or on the basis of our legitimate interest, as applicable.
To send you service, technical and other administrative or technical email, messages, and other types of notifications (such as distribution and product updates and product patches and fixes). To perform our contract with you and to deliver a Vaticle Product, or on the basis of our legitimate interest, as applicable.
Support Data: Data you provide or we otherwise access in connection with support queries we receive from you. This may include, for example, first name, last name, and email address. For some of our Vaticle Products, you may also have an option to provide location or time zone, phone number. To resolve any support requests and to deliver, develop and improve our Vaticle Products. To perform our contract with you and to deliver a Vaticle Product, or on the basis of our legitimate interest, as applicable.
Payment Data: Data that you provide or we otherwise access in connection with your payment to us for Vaticle Products we provide. This may include, for example, bank account and payment card details order identification, billing address, date/time/amount of transaction, merchant name/identification, location. To effect payment that is necessary for the provision of our Vaticle Products; to ensure compliance with laws that apply to us (e.g. compliance with Anti – Money Laundering and fraud prevention obligations). To perform our contract with you and to deliver a Vaticle Product, or on the basis of our legitimate interest as applicable. We will also process your personal information to comply with our legal obligations.

When you use our Vaticle Products, we may also collect certain information automatically from your device. In some countries, including countries in the European Economic Area, this information will be considered personal information under applicable data protection laws.

Log and usage data: Vaticle Product-related, diagnostic, usage, and performance information our servers collect when you access or use our Vaticle Products and which we record in log files. This log data may include the Internet Protocol (IP) address, device information, browser type and settings and information about your activity in the Vaticle Products (such as the date/ time stamps associated with your usage, pages and files viewed, searches and other actions you take (for example, which features you use), device event information (such as system activity, error reports and hardware settings. To maintain the security of the Vaticle Products, provide necessary functionality, improve the application and its performance, assess, and improve your experience, check compliance with applicable terms; identify future opportunities for development of the Vaticle Products, assess capacity requirements, analyse overall trends, and to help us provide and improve our Vaticle Products. To perform our contract with you and to deliver a Vaticle Product, or on the basis of our legitimate interest, as applicable.

Some of this information may be collected using cookies and similar tracking technology as explained above.

Information that we obtain from third party sources: From time to time, we may receive personal information about you from third party sources, but only where we have checked that these third parties either have your consent or are otherwise legally permitted or required to disclose your personal information to us.

HOW WE TREAT PERSONAL DATA

Vaticle uses collected data to operate our business for legitimate purposes. We may need to transfer data including your Personal Data outside of the United Kingdom in order to provide you with the Vaticle Products you require or as necessary for Vaticle’s legitimate interests. Any such transfers are carried out with safeguards in place to ensure the confidentiality and security of your personal information. Transfers are protected either by ‘adequacy regulations’ issued by the UK Government (declaring the recipient country as a ‘safe’ territory for personal data) or by standard contractual clauses with obligations for the recipient to safeguard the data.

We may share your Personal Data on a limited access basis with third-party business partners to the extent reasonably necessary for the purpose of providing Vaticle Products to you. We will require that such persons comply with this Privacy Policy.

We may transfer or assign information as reasonably necessary in the course of a business sale or other such transaction, or a corporate sale, mergers, acquisitions, bankruptcies, dissolutions or similar transactions or proceedings. We will require that such persons comply with this Privacy Policy.

We will disclose Personal Data where required to do so by law regulation or court order or if we reasonably believe that such action is necessary (a) for legal compliance or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our contracts, take precautions against liability, to investigate and defend ourselves against any claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and/or (c) to exercise or protect the rights, property, or personal safety of Vaticle, our customer or others.

Information other than Personal Data: We may share information that is not Personal Data, including information obtained through tools such as cookies, log files, and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our third-party business partners for the purposes described in the section above on “What We Collect And How We Use It.” We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with our third-party business partners.

HOW WE PROTECT YOUR INFORMATION

We maintain commercially reasonable physical, technical, and procedural safeguards in connection with the collection, storage and security of all information. Our security procedures mean that we may take reasonable steps (such as requesting a unique password or proof of identity) before we disclose personal information to you or granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Vaticle, at all times.

In the event that any information under our control is compromised as a result of a breach of security, Vaticle will take reasonable steps to investigate the situation and where appropriate, to notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Notwithstanding the foregoing measures, Vaticle cannot (and we do not believe that anyone can) guarantee the absolute security of any information you transmit to Vaticle or that it will not be accessed, disclosed, altered, or destroyed. Accordingly, to the extent permitted by law, and absent Vaticle’s gross negligence, customers and users agree to not hold Vaticle responsible for the theft, destruction, loss, damage or inadvertent disclosure of Personal Data or other data provided to Vaticle.

YOUR CHOICES ABOUT YOUR INFORMATION

Withhold Your Personal Data: You may, of course, decline to submit any Personal Date, in which case Vaticle may not be able to provide certain Vaticle Products to you.

Modifying Your Account Information and Settings: You may update your account information at any time by logging in to your account and navigating to the user profile page where you can adjust your notification settings. You can also stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. As noted above, you may not opt out of Vaticle Product-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to Vaticle Product features) unless you terminate your account.

Avoiding Collection of Information other than Personal Data: The only way to completely “avoid” the collection of any information through cookies or other technology is to actively manage the settings on your browser. Please refer to your browser’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. Note that disabling cookies on your browser prevents Vaticle or its business partners from tracking your browser’s activities in relation to Vaticle Products, and for use in targeted online advertising. However, doing so may disable many of the features available through the Vaticle Products.

Under applicable data protection legislation, you may have certain rights regarding Personal Data stored about you. These may include the right to: (a) be informed about how your Personal Data is being used; (b) access Personal Data; (c) have incorrect Personal Data updated; (d) have Personal Data erased; (e) stop or restrict the processing of your Personal Data; data portability (allowing you to get and reuse your data for different Vaticle Products); and (d) object to how your Personal Data is processed in certain circumstances.

To exercise any of the above listed rights, please contact Vaticle at the addresses set out below. Vaticle will process requests in accordance with applicable law, with reasonable efforts and within a reasonable period of time.

RETENTION OF DATA

We may retain data, including Personal Data, for as long as necessary to deliver Vaticle Products or as needed for other lawful purposes. We may retain anonymized or pseudonymized, aggregated data indefinitely or to the extent permitted under applicable law without further notice to you.

THIRD PARTY LINKS

This website may include links to third-party websites, plug-ins and applications. Although Vaticle only looks to include quality, safe, and relevant external links, users are advised to adopt a policy of caution before clicking any external web links included throughout this website. (External links are clickable text/icon/banner/image links to other websites.)

Clicking on those links or enabling those connections may: allow third parties to collect or share data about you; send you to the external website through a referral program which may use cookies and may track the number of referrals sent from this website; include the use of cookies which may in turn be saved on your computer’s hard drive.

Vaticle does not control these third-party websites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

SOCIAL MEDIA PLATFORMS

Communication, engagement and actions taken through external social media platforms that we participate in are subject to the terms and conditions as well as the privacy policies held with each social media platform respectively.

Users are advised to use social media platforms wisely and communicate/engage upon them with due care and caution in regard to their own privacy and personal details. Vaticle will never ask for personal or sensitive information through social media.

This website may use social sharing buttons which help share web content directly from web pages to the social media platform in question. Users are advised before using such social sharing buttons that they do so at their own discretion and note that the social media platform may track and save your request to share a web page respectively through your social media platform account. We are not responsible for any content generated by user while using this function.

Vaticle may, through their social media platform accounts, share web links to relevant web pages. By default, some social media platforms shorten lengthy URLs. Users are advised to take caution and good judgment before clicking any shortened URLs published on social media platforms by this website and its owners. Despite the best efforts to ensure only genuine URLs are published many social media platforms are prone to spam and hacking and therefore this website and its owners cannot be held liable for any damages or implications caused by visiting any shortened links.

PROTECTION OF CHILDREN

Vaticle Products are not designed for, or intentionally targeted at, children 13 years of age or younger. We do not intentionally collect or maintain data about anyone under the age of 13.

By using any Vaticle Product, you are representing that you are not under the age of thirteen. If we obtain knowledge that a child under the age of thirteen has provided us with Personal Data, we will promptly delete such information. If you are a parent or guardian and discover that your child has provided any such Personal Data to us, then you may contact us at the email or mailing address noted at the end of this Privacy Policy below and request that we delete that information from our systems.

LAW & JURISDICTION

This Privacy Policy and all questions of construction, interpretation, validity and performance under this Privacy Policy including non-contractual disputes or claims shall be governed by English law and subject to the exclusive jurisdiction of the English courts.
